These Terms of Use (hereinafter, the "Terms") govern the access, registration, contracting and use of the ZenitJob platform, accessible at zenitjob.com (hereinafter, the "Platform" or the "Service"). Use of the Platform confers the status of user (hereinafter, the "User") and implies full and unreserved acceptance of each and every one of these Terms. If you do not agree with them, please do not use the Service.

1. Identification of the owner

In compliance with article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), we hereby inform you that the Platform is owned by:

2. Purpose and description of the Service

ZenitJob is an online platform aimed at professionals that helps them organize and optimize their job search. The Service includes, among others, the following features:

  • Creation and management of a base résumé and of versions tailored to specific job openings.
  • Artificial intelligence assistance tools for drafting and improving the content of the résumé and other professional texts.
  • Searching for, importing and tracking job openings.
  • Management and tracking of the status of applications.
  • Analysis of the résumé's compatibility with automated screening systems (ATS).

The specific scope of the features available depends on the plan contracted, as detailed on the plans and pricing page. ZenitJob is a support tool: it does not guarantee obtaining a job, an interview or any response from third parties, nor does it act as an intermediary in the relationship between the User and employers.

3. Registration and User account

To access most of the features it is necessary to create an account. The User undertakes to:

  • Provide truthful, accurate and up-to-date information at the time of registration and keep it updated.
  • Keep their access credentials confidential and not transfer them to third parties.
  • Immediately notify ZenitJob of any unauthorized use of their account.

Registration is reserved for persons over 18 years of age with the legal capacity to enter into contracts. The account is personal and non-transferable. The User is responsible for all activity carried out through their account.

4. Acceptable use conditions

The User undertakes to make lawful and diligent use of the Service. In particular, it is prohibited to:

  • Use the Platform for unlawful or fraudulent purposes or purposes contrary to good faith.
  • Introduce false or defamatory content, or content that infringes third-party rights or breaches applicable law.
  • Impersonate the identity of another person or entity.
  • Attempt to gain unauthorized access to the systems, breach security measures or interfere with the operation of the Service.
  • Carry out mass or automated data extraction (scraping), except with express written authorization.
  • Resell, sublicense or commercially exploit the Service without authorization.

5. Plans, prices and contracting

ZenitJob offers a free plan with limited features and paid plans with expanded functionality. The prices, features and, where applicable, the usage limits of each plan are described on the plans and pricing page, which forms an integral part of these Terms.

All prices are shown in euros (€) and include, where applicable, the applicable indirect taxes. The contracting process takes place online: the User selects the plan, reviews the order summary and confirms the payment. Confirmation of the purchase is sent by email, together with the corresponding invoice or receipt.

ZenitJob's paid plans are a subscription with automatic renewal. Before confirming the payment, you are clearly informed of the amount, the frequency (monthly or annual) and the fact that the subscription will renew automatically. At the end of each period, ZenitJob will automatically charge the User's payment method the amount of the plan for the following period, until the User cancels the renewal. The User may cancel at any time, easily and in a single click, from their profile, with no minimum commitment or penalties. Usage bundles are a one-off purchase (single payment) and do not constitute a subscription and are not renewed.

6. Payments and billing

Payments are processed through the secure payment gateway Stripe Payments Europe, Ltd., a provider specialized in processing online transactions. ZenitJob does not store the full payment card details on its systems: such data is processed directly by the gateway in accordance with the PCI-DSS security standard.

The User warrants that the payment method used belongs to them or that they have legitimate authorization to use it. In the event of non-payment, refund or unjustified chargeback, ZenitJob may suspend access to the paid features. For more information on security, see our fraud prevention page.

7. Right of withdrawal

In accordance with Royal Legislative Decree 1/2007, approving the consolidated text of the General Law for the Defence of Consumers and Users, the User who qualifies as a consumer has a period of 14 calendar days from the time of contracting to withdraw from the contract without the need for justification.

However, as this is the provision of a digital service, the User acknowledges and accepts that, if they request the immediate commencement of the service and use it during the withdrawal period, they will lose the right of withdrawal once the service has been fully performed, or else will pay an amount proportional to the part already provided, in accordance with article 102 et seq. of that law.

To exercise the right of withdrawal, it is sufficient to send an unequivocal communication to legal@zenitjob.com within the period indicated.

8. Automatic renewal and cancellation

Paid plans are contracted as a subscription with automatic renewal. Unless previously cancelled by the User, at the end of each period (monthly or annual, depending on the plan chosen) the subscription renews automatically for an equal period and ZenitJob charges the current amount of the plan to the payment method. The amount, the frequency and the automatic nature of the renewal are clearly disclosed prior to confirmation of the payment.

The User may cancel the renewal at any time, easily and in a single click, from their profile, with no minimum commitment or penalties. Cancellation takes effect at the end of the current period: the User retains access to the contracted features until that date and will not be charged again. Cancellation of a period already started does not give rise to a refund, except as provided in the withdrawal clause or any more favourable conditions that ZenitJob expressly offers on the plans page.

9. Artificial intelligence

Some ZenitJob features use generative artificial intelligence systems and models. The interface identifies these features so that the User knows when they are interacting with AI or receiving AI-generated or AI-assisted content.

  • AI may assist with extracting and drafting résumé data, tailoring résumés, cover letters and messages, translation, job and application analysis, compatibility scores and job-search coaching.
  • Results are automatic suggestions and may contain inaccuracies, omissions or unsuitable wording. ZenitJob does not guarantee their accuracy, suitability or absence of errors.
  • The User must review, validate and, where necessary, correct every result before using, downloading, publishing or sending it to third parties. The User decides which final content to use.
  • Scores, ATS analyses, recommendations and compatibility estimates are advisory and non-binding. They do not guarantee that a résumé will pass a filter or that the User will obtain an interview or employment.
  • ZenitJob does not make hiring decisions, does not reject the User on behalf of an employer and does not use these features to make automated decisions that produce legal or similarly significant effects on the User. Selection decisions are made by the employer outside ZenitJob.
  • If the User publishes AI-generated or AI-manipulated content to inform the public about matters of public interest, they must retain a clear disclosure of its artificial origin where required by applicable law.

10. Intellectual property

All elements of the Platform (code, design, interface, trademarks, logos, texts, structure and databases) are owned by Total Market Services, SL or its licensors, and are protected by intellectual and industrial property legislation. Their reproduction, distribution, transformation or public communication is prohibited without express authorization.

11. User content

The User retains ownership of the content they provide (résumé data, texts, applications, etc.). By using the Service, they grant ZenitJob a limited, non-exclusive and revocable licence to process such content for the sole purpose of providing the Service. The User warrants that they hold the necessary rights over the content they provide and that it does not infringe third-party rights.

12. Data protection

The processing of the User's personal data is governed by our Privacy Policy, drawn up in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). We recommend that you read it.

13. Availability and limitation of liability

ZenitJob endeavours to keep the Service available on a continuous basis, but does not guarantee the absence of interruptions, errors or unavailability resulting from maintenance, technical failures or force majeure. To the maximum extent permitted by law, ZenitJob shall not be liable for:

  • The decisions the User makes based on the information or suggestions of the Platform.
  • The outcome of selection processes or of the applications submitted.
  • Indirect damages, loss of profit or loss of opportunities.
  • The content, practices or truthfulness of job openings, companies or third-party sites linked from the Platform.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited with respect to a consumer.

14. Suspension and account closure

ZenitJob may suspend or cancel the User's account, with prior notice where possible, in the event of a serious breach of these Terms, fraudulent use or activity that jeopardizes the security or operation of the Service. The User may request the closure of their account at any time from their profile or by writing to info@zenitjob.com.

15. Amendments

ZenitJob may amend these Terms to adapt them to legal, technical or Service changes. Substantial amendments will be communicated by email or through a notice on the Platform with reasonable advance notice. Continued use of the Service after the changes take effect implies acceptance of them.

16. Applicable law and dispute resolution

These Terms are governed by Spanish law. For the resolution of any dispute, the parties shall submit to the courts and tribunals that are competent under the applicable law; in the case of a consumer, the courts of their domicile shall have jurisdiction.

The consumer User is also informed of the existence of the European online dispute resolution platform, available at ec.europa.eu/consumers/odr.
